APPLICATION OF TERMS
Terms & Conditions apply exclusively to every booking agreement with any client, and that all quotations are made and all orders are accepted on and subject to these Terms & Conditions. No terms introduced by the customer shall take priority over the Company's Terms & Conditions. Following payment of a deposit, every customer will be required to digitally sign a contract agreeing to these terms and conditions. No booking is confirmed until this contract has been digitally signed. Wild Revival Photo and Film Ltd reserve the right to cancel any ‘booking’ / part booking and refund any deposits made by the customer in any case where this contract is not digitally signed by the customer.
PAYMENTS
Payments can be made via credit / debit card or via BACS transaction.
BALANCE DUE
The final balance amount is due at least 14 calendar days before the event date. Any method of payment on the event date will not be accepted. Services will not be supplied to the client if the balance due amount has not been paid in full.
ADDITIONAL EXPENSES
Any additional expenses will be communicated with the client before booking. No charge is requested for mileage or overnight accommodation within the UK.
MEDIA (FILM)
All edited films (inc. speeches, ceremony, feature film, engagement film) will be delivered via an online platform. All films delivered via online platform will be hosted for 10 years. All films will be available for the client to download for 1 year from date of delivery. The client is responsible for downloading films and sharing the online portal address with whom they choose. All raw film footage (if purchased) will be delivered via USB sent by recorded post to the client’s address (due to file size). In addition, all media will be backed up and stored offline by Wild Revival Photo and Film Ltd for a minimum of 6 months following delivery to the client.
MEDIA (PHOTO)
All edited photographs will be delivered via an online platform and will be hosted for at least 2 years. All photographs will be available for the client to download at any time whilst hosted online. The client is responsible for downloading photographs and sharing the online portal address with whom they choose. Physical products (albums / prints) are not included within the quote / invoice and are purchased separately by the client.
ELOPEMENTS
The elopement package is intended to serve couples looking to get married away from a typical wedding venue with just themselves or in some cases a very limited number of persons present. Wild Revival Photo and Film Ltd reserve the right to refuse offering this package in any case where they feel that the wedding / elopement described by the customer / enquiry, does not meet the terms that define a typical elopement / the service offered in this package.
NUMBER OF GUESTS
Upon booking any service, the customer is responsible for providing an approximate number of expected guests to be present at the wedding. The quality of service provided on the day and the amount of coverage Wild Revival Photo and Film Ltd are able to provide may be impacted in any case whereby the number of guests that end up being actually present far exceed the expected number provided by the customer.
ENGAGEMENT SHOOT
An engagement shoot is currently offered as free with any wedding PHOTOGRAPHY package. The engagement shoot is only available to the customer / couple due to be wed. The customer understands that filming / photographing weddings will take priority and therefore agrees to be flexible on dates and will allow for any planned engagement shoot to be rearranged. This will be communicated to the customer as soon as possible.
VIDEO GUEST BOOK / PRE-WEDDING INTERVIEWS / GUEST CAMCORDERS
The above extras are optional and are offered free with any wedding FILM package. All extras if selected will be offered during the wedding for which a film package is purchased (except any pre-wedding interviews that may take place instead of / as well as during an engagement shoot)* . The customer acknowledges that these services rely on the couple / guests being willing to take part and making themselves available during the wedding day. The customer also acknowledges that these services may also result in less coverage of the wedding day itself / unplanned or non-communicated events being missed.
*In cases where both a photography and film selected are purchased together and the customer takes advantage of said engagement shoot and is willing to take part in filming pre-wedding interviews. This will be discussed with the customer in any appropriate case.
OBLIGATIONS
Both Stewart Turner and Gemma Turner of Wild Revival Photo and Film Ltd agree to devote their full time, attention and ability for the duration of the wedding day.
Elements beyond Stewart Turner's / Gemma Turner's control such as: equipment failure, damage to media storage, civil disturbances and/or weather conditions, road closures, traffic jams and accidents (Acts of God) which may inhibit or prevent Stewart Turner / Gemma Turner from completing in whole or in part; In such events refunds are negotiable dependant on severity of outcome. Stewart Turner / Gemma Turner will have back up equipment and media cards on their person to minimise the incidence of such occurrences. They will endeavour to avoid traffic jams etc wherever possible.
DEADLINES
Due to the dedication to quality of work produced and because of varying peaks in demand for service, no exact deadlines are offered, only guidelines, as follows:
In the case of photographs, Wild Revival Photo and Film Ltd aims to deliver a full online gallery within 12 weeks. Previews will be released to the client beforehand within a week of the wedding date.
In the case of films, Wild Revival Photo and Film Ltd aims to deliver all films purchased at time of booking within 3-6 months. Teaser reels may be released on our social media beforehand to add to the couple's overall experience however no agreed number of reels, etc. is given.
CANCELLATIONS
Wild Revival Photo and Film Ltd reserves the right to cancel the agreement in any of the following scenarios:
Death or serious injury / illness of a close family member of Stewart Turner or Gemma Turner
Injury to or illness of Stewart Turner / Gemma Turner personally.
By mutual consent of both parties.
The client reserves the right to cancel the booking agreement at any time, by doing so in writing to Wild Revival Photo and Film Ltd. Any initial booking fee paid is non-returnable. Cancellations made within the following time scales will also be liable for the following further cancellation charges:
60 Days or less - 50% of the Balance Due Amount.
30 Days or less - The full value of the Balance Due Amount.
Cancellations must be made in writing or emailed by the client. For security reasons they will not be accepted over the phone.
ILLNESS & ACCIDENTS
In the event of accident or illness preventing the videographer(s) / photographer(s) from appearing the client shall be informed at the earliest opportunity and, if requested by the client, medical evidence will be provided. The client will not be obliged to pay a fee for any services Wild Revival Photo and Film Ltd is unable to provide.
CHANGE OF DATE / COVID
If for any reason you need or want to change your date of the wedding there is a fee of £300 to do so. These terms come into effect if the date change is 14 months or less from the original wedding date. This is regardless of the circumstances, unless related to government-imposed coronavirus restrictions (please see below). This fee is due to Wild Revival Photo and Films Ltd most likely turning down numerous enquiries for the same date and therefore will effectively be losing out on income.
If you are looking to hold a new date as well as your original one, and this date is available, it can be provisionally held. However, if an enquiry is made for the new date, Wild Revival Photo and Film Ltd will contact you to see what your plans are. If at that time you would like to secure it officially, then the £300 rearrangement fee will need to be paid upfront to hold the date, this will be non-refundable. If the new date is not secured at this point, Wild Revival Photo and Film Ltd will accept other bookings for the new date.
There will be no change of date fee if you move your wedding as a result of government-imposed coronavirus restrictions, however any change of date under these circumstances is subject to availability.
INSURANCE
Wild Revival Photo and Film Ltd undertakes to obtain insurance against liability for professional negligence and against circumstances which prevent Wild Revival Photo and Film Ltd from fulfilling this contract. Proof of public liability insurance can be provided at request.
BEHAVIOUR
The client is held fully responsible for their own and their guest's behaviour. Videographers and photographers will not tolerate abusive clients and/or guests and will cease production in the event of threatening behaviour. We reserve the right to end all services early, without prior notice or refund, in the interests of personal safety.
BOOKINGS
Bookings are accepted on the completion of the booking contract and the payment of the booking fee / deposit. This can be paid via bank transfer or credit / debit card. A non-returnable deposit payment is required to book.
FILMING / CREATIVITY / REVISIONS
Wild Revival Photo and Film Ltd will be the exclusive professional videography and/or photography service in attendance. Friends and family are permitted to take video or photographs on the condition that they do not interfere with or get in the way of professional coverage.
Creative aspects such as shooting and editing style are at the discretion of Wild Revival Photo and Film Ltd, this includes choice of footage shown in any film and music selection. Wild Revival Photo and Film Ltd will not use any un-licensed music in any production, period.
Wild Revival Photo and Film Ltd does not agree to provide any revisions of films / photographs delivered to the client.
CONSENT
The client is fully responsible for ensuring that all consents are provided, and any required fees paid so that the videographer and/or photographer can carry out the agreed service. This includes, but is not limited too, permission to film in the church/venue, permission to film persons involved, i.e. musicians, entertainers, guests.
Wild Revival Photo and Film Ltd must be notified of any consent issues at least 30 days prior to the event.
DRONE COVERAGE
Any agreement to drone coverage is subject to imposed flying restrictions and/or weather conditions. There will be no additional charge for any use of drones at the event, however the use of drone coverage is at the discretion of Wild Revival Photo and Film Ltd.
COPYRIGHT
Wild Revival Photo and Film Ltd retain copyright for all work produced (edited and unedited photographs and video) and may freely use / display any imagery related to the event, for the purposes of advertising and promotion including but not limited to website/s, social media, exhibition displays, entry into awards, unless both parties have signed an agreement otherwise beforehand.
Wild Revival Photo and Film Ltd give consent to the client to print and share any film / photograph provided.
COMPLAINTS
In the event of any complaint, the client should attempt to rectify the problem with the videographer / photographer representing Wild Revival Photo and Film Ltd on the date of the event. Where this is deemed not possible, complaints should then be made in writing within 30 calendar days of the event date. Complaints will be fully investigated and a response made available to the client within 14 calendar days.
EQUIPMENT OPERATION
Only representatives of Wild Revival Photo and Film Ltd may operate company equipment. Under no circumstances, may unauthorised personnel tamper with, move or attempt to use equipment owned by Wild Revival Photo and Film Ltd. We cannot accept any responsibility for damage caused to the event venue, or injury caused to the client, guests and/or venue staff caused directly by third party intervention.
FORCE MAJEURE
The client agrees that Wild Revival Photo and Film Ltd shall not be liable for any and all losses, including damages, costs, claims, compensation and other liabilities which arise as a result of any delay or interruption in, or any non-delivery, missed delivery or failure of the equipment and / or services due to circumstances beyond our or any of our suppliers' and contractors reasonable control (including, but not limited to, fire, lightning, explosion, war, disorder, flood, industrial dispute, sabotage, weather conditions, road closure, vandalism, traffic congestion, vehicle failure or acts of local or central government or other competent authorities).
Our maximum liability arising out of or in connection with the non-supply of services on the event date and at the venue location shall be limited to the total value of the booking agreement fee in pounds.
GENERAL
The booking agreement shall be governed by and construed in accordance with the laws of England and Wales and you agree to submit to the exclusive jurisdiction of the courts of England and Wales. In the event that the agreement is translated into any other language, the English language version shall prevail. You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party.
If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.
All terms and conditions stated in this contract are agreed by the client and representatives of Wild Revival Photo and Film Ltd and do not cover other additional vendors / services purchased by the client.
HEALTH AND SAFETY
It is the responsibility of the client to ensure the venue complies with current Health & Safety Regulations, holds all necessary certification including Public Liability Insurance, Public Performance Licenses, and where applicable, relevant PAT test certification.
Wild Revival Photo and Film Ltd ensures that equipment fully complies with the relevant and current Health & Safety legislation regarding the equipment and company staff.
It is the responsibility of the client and/or venue to provide a safe & suitable area within the venue location to facilitate installation of equipment. Any floor surface, staging, mounting area or electricity supply which is deemed unsuitable or unsafe by the videographer / photographer may delay or prevent installation of equipment. If installation cannot be completed successfully the client cannot be provided with any Services. In this event no refunds, in part or full, will be given for non-use of equipment that cannot be used due to any Health & Safety implications imposed on the videographer / photographer by the client and/or venue.
PRICES AND QUOTATIONS
All package prices are fully inclusive of delivery, labour, and insurance. Quotations are valid for 7 days.
VENUE ACCESS
The client and/or venue must make at least one safe & suitable parking space available to the videographer / photographer, at no cost to Wild Revival Photo and Film Ltd, to facilitate safe & prompt unloading of the equipment. The client shall notify Wild Revival Photo and Film Ltd at least 14 calendar days prior to the event date if this is unavailable. In this event Wild Revival Photo and Film Ltd reserves the right to make its own parking arrangements and charge this cost in full to the Hirer.
HOTEL AND OVERNIGHT ACCOMMODATION
Wild Revival Photo and Film Ltd do not charge for hotel or overnight accommodation for any wedding in the UK. If suitable, permission may be requested for overnight parking (and subsequently overnight accommodation - within our camper van) at the venue of the wedding (reception venue in the case of multiple venues) on the night of the wedding.
In the case of overseas weddings, any travel / accommodation fees will be agreed upon at the time of booking.
ADDITIONAL PHOTOGRAPHER / VIDEOGRAPHER
Wild Revival Photo and Film Ltd cannot be held responsible for the actions of any additional photographer / videographer not directly employed by Wild Revival Photo and Film Ltd. For example, if they become ill, are late, system failure or non-attendance. Wild Revival Photo and Film Ltd can also not be held responsible if the footage from any additional photographer / videographer is not to your liking. Wild Revival Photo and Film Ltd will seek to only offer a reliable and qualified photographer / videographer and will not select anyone who is believed to not be suitable for the position.
